1. Eligibility and site use

You must be at least 18 years old or the age of legal majority where you live to make a purchase. You agree to use the Site only for lawful purposes and to provide current, complete, and accurate information when ordering or contacting us.

You may not interfere with the Site, attempt unauthorized access, introduce malicious code, scrape or harvest content, misuse another person's information, or use the Site in a way that violates law or the rights of others.

2. Products and product information

Thoughtful Days Co. offers digital downloads, personalized digital stationery, printed invitations, labels, tags, reusable guides, party-planning resources, daycare-planning tools, and related products. The product listing in effect at the time of purchase identifies what is included. Images, mockups, examples, and styled scenes are for illustration unless the listing expressly states that the pictured item is included.

We make reasonable efforts to describe products accurately. Colors and appearance may vary because of monitor settings, printers, paper, ink, software, and other conditions outside our control. We may correct typographical errors, update descriptions, change prices, discontinue products, or limit quantities at any time.

3. Orders, pricing, and payment

Prices are shown in the currency displayed at checkout and may change without notice. Applicable taxes and charges are added when required. Payment is due at checkout through the payment methods offered on the Site. An order confirmation does not obligate us to fulfill an order affected by a material pricing error, suspected fraud, unauthorized activity, or inability to complete the requested work. If we cancel an order after payment, we will issue an appropriate refund.

4. Digital delivery

Digital products are delivered through the method stated in the listing or order confirmation. You are responsible for providing a valid email address, maintaining access to it, downloading files within any stated access period, and retaining a personal backup. No physical item is shipped unless the listing expressly states otherwise.

4A. Physical production and shipping

Thoughtful Days Co. currently prints and prepares physical products in-house. Unless a listing states otherwise, standard production is estimated at 3–5 business days after final proof approval for personalized products or order confirmation for universal, non-personalized products. Business days exclude weekends and holidays. Proofing, revisions, customer response time, and carrier transit time are not included in the production estimate.

Shipping options, charges, and available delivery estimates are shown at checkout when available. Carrier estimates are not guaranteed. You are responsible for providing a complete and accurate shipping address and ordering with sufficient time before an event. Risk of delay may increase during holidays, severe weather, carrier disruptions, or high-volume periods. Additional terms appear in the Shipping & Delivery Policy.

5. Personalized orders and customer-supplied information

You are responsible for submitting accurate, complete, lawful content and for having permission to provide and use all names, photographs, wording, logos, addresses, and other materials you submit. Do not submit confidential child-care records, medical information, financial account information, government identification numbers, or other sensitive information that is unnecessary for the order.

Personalized orders include one initial proof and up to two rounds of minor revisions unless the listing states otherwise. Timelines depend on receiving complete information and timely responses. Delayed responses, new information, or revision requests may extend delivery. Major changes or additional revisions may require an additional fee.

You must review the complete proof before approval. Approval confirms that all content is correct. We are not responsible for customer-submitted errors or errors approved in the proof. We will correct an error introduced by Thoughtful Days Co.

For a printed personalized order, final proof approval authorizes production. Once printing begins, the order cannot be changed, canceled, or returned. A customer-approved error may require a paid reprint. If our physical product does not materially match the approved proof because of our error, we will provide an appropriate correction, replacement, or refund after timely notice and review.

6. License to use purchased products

All products are licensed, not sold as intellectual property. Unless a listing expressly grants different rights, Thoughtful Days Co. grants the original purchaser a limited, nonexclusive, nontransferable, revocable license to use the purchased product for the purchaser's own personal use or, for a daycare-business product, within one independently operated daycare business or location.

You may create reasonable backup copies for your own permitted use. You may print personal-use copies of printable party materials for the event associated with your purchase. No ownership rights are transferred to you.

7. Prohibited uses

• Sharing, forwarding, sublicensing, selling, renting, gifting, or redistributing files, passwords, download links, or access credentials.

• Uploading products to shared drives, group resources, membership libraries, social media, marketplaces, websites, or file-sharing services.

• Copying, extracting, reverse engineering, or repackaging designs, formulas, workbook logic, guides, wording, graphics, or other content to create a competing or derivative product.

• Using purchased files to create products for sale, client work, print-on-demand products, templates, or commercial downloads without written permission.

• Removing copyright, trademark, attribution, watermark, access-control, or rights-management notices.

8. Intellectual property

The Site and its content, including designs, text, graphics, logos, product names, photographs, guides, spreadsheets, formulas, organization, selection, and arrangement, are owned by or licensed to Thoughtful Days Co. and are protected by applicable intellectual-property laws. Thoughtful Days Co. and related branding may not be used without prior written permission.

9. Daycare tools and informational disclaimer

Daycare workbooks, calculators, trackers, guides, and examples are informational planning tools. They do not provide legal, licensing, accounting, tax, financial, employment, insurance, safety, or professional advice, and they do not make decisions for you. You remain responsible for verifying current laws, licensing rules, agency guidance, contract requirements, and the accuracy of all information entered.

Results, forecasts, capacity calculations, openings, eligibility indicators, rates, and revenue estimates depend on user inputs, settings, assumptions, software behavior, and rules that may change. We do not guarantee a particular operational, licensing, enrollment, revenue, or financial outcome.

10. Software compatibility and technical requirements

You are responsible for reviewing product compatibility before purchase and for obtaining required software, hardware, internet access, and technical ability. A product designed for Microsoft Excel may not work fully in Google Sheets, Apple Numbers, browser-based spreadsheet tools, older Excel versions, or other unsupported applications. Updates to third-party software may affect functionality.

11. Shop the Look and third-party links

The Site may link to products, services, or websites operated by third parties. These links are provided for convenience and inspiration. Third parties control their own products, prices, inventory, colors, quality, shipping, privacy practices, returns, warranties, and terms. Thoughtful Days Co. does not guarantee or assume responsibility for third-party offerings.

Some links may be affiliate links, meaning Thoughtful Days Co. may earn a commission from a qualifying purchase at no additional cost to you.

12. Refunds and cancellations

Purchases are governed by our Refund & Cancellation Policy, incorporated into these Terms by reference. Digital products are generally nonrefundable once delivered, accessed, or downloaded. Customized and personalized products may be canceled only before customization or production begins and are otherwise final sale, except where applicable law requires otherwise. Eligible universal, non-personalized physical products may be returned within 14 days of delivery under the conditions stated in that Policy.

13. Accounts and access

If the Site allows accounts or password-protected access, you are responsible for maintaining the confidentiality of your login information and all activity under your account. Notify us promptly if you suspect unauthorized access. We may suspend access when reasonably necessary to protect the Site, enforce these Terms, or investigate misuse.

14. Disclaimer of warranties

To the fullest extent permitted by law, the Site and products are provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and noninfringement, to the extent those warranties may legally be disclaimed. We do not warrant that the Site or products will be uninterrupted, error-free, compatible with every system, or suitable for every user's circumstances. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

15. Limitation of liability

To the fullest extent permitted by law, Thoughtful Days Co. and its owner, members, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, business opportunities, enrollments, or goodwill; or decisions made using a product. To the fullest extent permitted by law, total liability arising from a specific purchase will not exceed the amount paid for that purchase. Nothing in these Terms excludes liability that cannot legally be excluded or limited.

16. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Thoughtful Days Co. from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Site or products, violation of these Terms, infringement of another person's rights, or materials you submit. This obligation does not apply to the extent a claim results from our own unlawful conduct.​

17. Suspension and termination

We may suspend or terminate access to the Site, downloads, password-protected resources, or accounts when we reasonably believe these Terms have been violated, access is being shared or misused, fraud or security risks exist, or suspension is required by law. Provisions that by their nature should survive termination will remain in effect, including intellectual-property, license, disclaimer, liability, and dispute provisions.

18. Governing law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles, except where mandatory consumer law provides otherwise. Any dispute that may be brought in court will be brought in a court of competent jurisdiction in Minnesota, unless applicable law gives you the right to bring it elsewhere.

19. Changes to these Terms

We may update these Terms as our products, practices, or legal obligations change. The revised Terms will be posted with a new effective date. Changes apply prospectively unless applicable law permits or requires otherwise. Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms.

20. Severability and entire agreement

If a provision of these Terms is found unenforceable, the remaining provisions remain effective, and the affected provision will be enforced to the greatest extent permitted. These Terms, the Privacy Policy, the Refund & Cancellation Policy, the Shipping & Delivery Policy, and product-specific terms shown at purchase form the agreement between you and Thoughtful Days Co. regarding the Site and purchases.
